John Workizer Will

I, John Workizer, of the township of Schuylkill, the county of Chester, being of sound mind and memory, do make and publish this my last Will and Testament in manner and form following viz:

Item 1 I give and bequeath to my son John when he arrives to lawful age, all that plantation, with the tavern stand and appurtenances thereunto belonging , situated in the township of Tredyffrin in the said county of Chester, adjoining lands of Jacob Detwiler, William Campbell, Daniel Baugh, John Jones and others, to him his heirs and assigns forever.

Item 2nd I give and bequeath to my daughter Tamson Amelia, when she arrives to lawful age, all that plantation and tavern stand with all the appurtenances thereunto belonging situated in the township of Schuylkill in the county aforesaid, bounded by lands of John Gwinn, Benjamin Boyer, David Shearer, Simon Anthony and others, together with two separate lots of woodland situated in the township aforesaid, one adjoining lands of Isaac Anderson, Samuel H. Davis and others, the other adjoining woodland of Samuel Herning, Isaiah Thropp and others, to her, her heirs and assigns forever.

Item 3rd I give and bequeath to my loving wife, Sarah, all the rents and profits, of the Estates, above bequeathed to my son and daughter John and Tamson Amelia until they shall each arrive to the age of twenty-one years, together with all my personal Estate of whatsoever description (except such part thereof as is hereafter otherwise bequeathed) she my wife to pay out of said personal Estate all my just debts and funeral expenses to educate my children John and Tamson Amelia during their minority in such manner as she may think proper. To Rent with the advice and consent of my Executors hereinafter named, the above bequeathed Estates , in the most safe and economical manner practicable having due regard to the saving of timber, suitable and necessary unpractiments(?)

Item 4 It is my will, and I hereby order and direct that when my son John arrives at legal age that the plantation and tavern stand, herein bequeathed to him shall be valued by three suitable persons, to be chosen by the said John and my wife Sarah and that the interest of one third the amount of such valuation be paid yearly and every year to my wife Sarah out of said devised Estate during her natural life and at her decease it is my Will that the same revert and remain in said Estate.

Item 5 In like manner I order and direct, that when my daughter Tamson Amelia shall arrive at lawful age, that the plantation and tavern stand herein bequeathed to her be valued as directed to be done with the estate devised to my son John, subject to the yearly interest of one third the amount of such valuation to be paid to my Wife during her natural life; and at her decease to revert to, and remain in said Estate. But if my Wife should marry during the minority of my said children then it is my will that my Executors have the sole management of my Estates entrusted to her during their minority; or if she marry at any time thereafter, then I order and direct that the yearly interest of on third as above directed to be paid out of the Estates devised to be reduced one fourth part thereof to the benefit and advantage of them my said children John and Tamson Amelia.

Item 6
And I do further order and direct that when my daughter Tamson Amelia arrives at legal age that all my personal Estate which may remain in the possession of my wife at that time after paying all my just debts and funeral expenses and for the maintenance and education of my children, John and Tamson Amelia, shall be appraised by three suitable persons to be chosen by them, my Wife and said children, and the amount thereof be equally divided between them, my Wife Sarah, my son John, and daughter Tamson Amelia.

Item 7
I give and bequeath to my daughter Ann, wife of Isaiah Thropp three separate lots of woodland situate in the township of Schuylkill aforesaid, one bounded by lands of Jeremiah Boileau, Isaiah Thropp and others, one adjoining lands of said Boileau, Robert Shanon and others known as the Slab Tavern lot, the other bounded by lands of Thomas Walker, Henry Pawling and others to her, her heirs and assigns forever.

Item 9 (there is no Item 8)
I order and direct that my real Estate, in West Kensington in the county of Philadelphia called Cottage garden, be sold as soon after my decease as convenient at the discretion of my Executors ( if the same should not be previously disposed of) and I do hereby vest in my Executors full power and authority to dispose of the said real estate in fee simple, in as full a manner in every respect as I could do myself if living - But it is my will that until the sale of the real estate my wife Sarah shall receive the rents and profits thereof.

Item 10
And I do further order and direct that the proceeds of said Kensington Estate be placed at legal interest by my Executors hereafter named as soon after the sale of said estate as they may find safe and convenient to do so, and the interest to be paid by them in the manner following viz: to my daughter Maria Matilda Lewis, the interest of one half the amount thereof, to Ann Thropp the interest of one third of the remaining half, and to my daughter Elisa D. Morley the interest of the remainder. The interest of said sums respectively to be paid to each of my daughters above named yearly and every year during their natural lives commencing as soon after the sale of the said Estate, as they, my said Executors may find a safe and suitable place to invest the said amount thereof, at their discretion - And at the decease of my daughters, as above named, it is my will that the said principal sums, respectively, be equally divided between the children of each of them, then surviving, by them, my said Executors or their legal representatives.

Item 11
Giving I aided my son in law, Joseph E. Anderson in the purchase of a plantation, and a tract of land late the property of Frederick Rapp deceased situate in the township of Schuylkill to the amount of half the cost of the property, I do hereby give and confirm to my daughter Rebecca wife of the said Joseph E. Anderson, the same with a further sum of five dollars, to be paid her by my Executors as her full proportion of my Estate.

Item12
I give and bequeath to my son John, my several shares of stock in the Bank of Montgomery County, also my stock in the Schuylkill Bridge at Norristown when he arrives to legal age.

Item 13
To my sons in law, Nathan Morley, William Lewis, Isaiah Thropp, and Joseph E. Anderson I give and bequeath to each the sum of five dollars.

Item 14
It is my will after my decease any of my stock of cattle, horses, farming utensils, or household furniture, shall be found to be useless the same may be sold, at the discretion of my wife and my Executors, and if my son John should desire to possess any particular house, it is my wish and desire that he shall have the same.

Item 15
I particularly order that if any of the above mentioned Legatees their husbands or agents, shall enter into any suit at law against my Will in any way or form those commuting such offense against my just rights, shall forfeit one half the Legacy herein bequeathed to them to the rest of the heirs to be equally divided among them.

Item 16
And lastly, I do hereby appoint William C. Conrad and my son John S. Workizer Executors of this my last Will and Testament, hereby revoking and making void all former Wills by me at any time made heretofore.
